The following were present: Gwathmey, Llahone,
Clark, Montague, Jenkins, Moore, Mrs. Carrie W. Moore .Harris.
On motion the following was unanimously passed:
WHEREAS, Benjamin Franklin Keith, of Pender County,
.North Carolina, died on the 30th day of April, 1924, leaving a
last will and testament, which was probated in Pender County,
North Carolina, shortly thereafter, in which said testator
devised and bequeathed to his Executors certain tracts of land
referred to in said will, with authority vested in said Execu¬
tors to sell said land at any time after five years from the
date of the death of said testator, and out of the proceeds
arising therefrom to pay one-tenth thereof to the "Home and
Foreign Missionary Board of the Southern Baptist Convention;”
and
WHEREAS, among the properties so devised in said will
are certain tracts of land aggregating between eleven hundred
and twelve hundred acres, known as the ”Lyon Swamp Land,”
situated in both Pender and Bladen Counties, North Carolinajand
WHEREAS, an offer of twenty-five thoiisand dollars
($25,000) cash has oeen made by Julian F. Keith to the Execu¬
tors of said Benjamin Franklin Keith for said lands, and the
other beneficiaries under the sixth clause of said will desire
that said sale be made to Julian F. Keith, who has offered
to purchase said lauds at said price, considering the same
a -desirable offer; and
WHEREAS, it is considered by a'll of the parties
in interest that a good and sufficient deed of conveyance
of said property can be now made by the Executors under said
will of said Benjamin Franklin Keith, provided all of the
beneficiaries shall unite in said conveyance; and
WHEREAS, it is considered to have been the in¬
tent of said testator to authorize and empower his Executors
to pay over one-tenth of the proceeds derived from the sale
of said property to the Home Mission Board of the Southern Bap¬
tist Convention and to the Foreign Mission Bo.rnrd bf the Southern
Baptist Convention together, or one-half of said one-tenth to
each of said Boards; and
WHEREAS , the Foreign Mission 3oard of the Southern
Baptist Convention is willing and considers it to be to its
interest to have the Executors of said Benjamin Franklin Keith
make sale of said Lyon Swamp Lands to said Julian F. Keith at
the purchase price of twenty-five thousand dollars ($25,000)
cash;
HOW, THEREFORE, BE IT RESOLVED:
1. That the Foreign Mission Board of tiie Southern Baptist
Convention, in meeting of the members threof having voting
power, after notice of such meeting, held on this the 15th day
of December, 1925, hereby approves the sale of that certain
portion of 1 aids mentioned in the sixth clause of the will of
Benjamin Franklin Keith, deceased, and known as the "Lyon
Swamp Lands,” containing between eleven hundred and twelve
hundred acres, and situated in both Pender and Bladen Counties,
in the State of North Carolina, to Julian F. Keith at the cash
purchase price of twenty-five thousand dollars ($25, 000) , and
the deeds of conveyance whereby said Benjamin Franklin Keith
acquired said lauds are hereby referred to for a more particular
description of the various tracts composing the same, viz:
